NextWave: T-Mobile is an 'insurrectionist'

In a Federal Communications Commission filing, NextWave said T-Mobile is "disobeying the rule of law" and that its statements are "insurrectionist." NextWave argued that T-Mobile's position on network interference is "a wild assertion that would undermine the FCC's licensing regime and render 2.5GHz and other spectrum licenses worthless." At issue is the 2.5GHz midband spectrum that sits at the heart of T-Mobile's 5G network. Due in part to the tortured history of licensing in that band, companies including NextWave in New York, Redzone Wireless in Maine and Bloosurf in Maryland have complained that T-Mobile's signals bleed into their own 2.5GHz coverage areas, causing interference to their customers. T-Mobile, for its part, recently deployed a new argument in its years-long battle with NextWave: If NextWave has no customers for its private network, it doesn't matter that T-Mobile's 5G service is operating inside NextWave's licensed spectrum territory.
