Draft Executive Order Could Clawback Nondeployment BEAD Funds

In a draft Executive Order, President Donald Trump claims Constitutional power to promote American leadership in artificial intelligence (AI) by:

1. establishing an AI Litigation Task Force to challenge state AI laws,
2. ordering the U.S. Secretary of Commerce to evaluate existing state AI laws,
3. restricting use of non-deployment BEAD funds by any state with an AI law,
4. similarly, requiring all agencies to assess their grant programs to determine if they can condition grants on states not having AI laws,
5. ordering the Chairman of the Federal Communications Commission to determine if the agency should adopt a Federal AI model reporting and disclosure standard that preempts state laws, and
6. recommending legislation to create a uniform Federal regulatory framework for AI that preempts state laws.
