Cities with their own broadband utilities and those looking to start them are hoping to disconnect Iowa statehouse proposals restricting their operation. A bill introduced in the Iowa Senate could prevent existing municipal communications utilities from offering discounted or competitive rates. It also would limit financing options for cities working to build their own fiber networks to provide internet, television and phone service to residents.

Vice President Mike Pence (R-IN) and White House Economic Adviser Larry Kudlow have both prominently endorsed Federal Communications Commission Chairman Ajit Pai’s plan for auctioning off the 5G-friendly C-band airwaves, and this GOP support could dim congressional Republican interest in legislative deal-making. But prominent Democrats and Republicans who wanted to legislate say there’s still a chance.

The White House rolled out its fiscal year 2021 funding requests, including a proposed 71 percent bump in congressional spending on the Justice Department’s antitrust division — an increase that is another indicator that the agency is serious about its pending investigations into tech giants like Google and Facebook. (It would also allow the agency to hire 87 additional staffers.) In contrast, the Federal Communications Commission and Federal Trade Commission aren’t requesting any big changes in their funding or staffing.

The percentage of end-user phone bills that go toward the Universal Service Fund (USF) has been climbing and there are serious questions about the sustainability of that funding mechanism, despite a relatively stable USF budget. The money for USF comes from companies that offer interstate and international long-distance telecom services (i.e., voice services). At one time most of the money went toward voice services but over the years, more and more of it has gone towards broadband.

Even before Federal Communications Commission Chairman Ajit Pai formally unveiled his plan for a C-band spectrum auction to reassign bandwidth for 5G wireless services, legislative and public interest forces began voicing their opposition to or endorsements for the proposal. 

Federal Communications Commission Chairman Ajit Pai proposed providing additional opportunities for unlicensed white space devices to deliver wireless broadband services in rural areas. Such devices operate in portions of the broadcast television bands (channels 2-35) and spectrum not being used for authorized services. Specifically, Chairman Pai is proposing to permit higher transmit power and higher antennas for fixed white space devices in rural areas.

Just how fast Americans can access 5G wireless service depends, in large part, on how effectively the guts of the network — namely, hundreds of thousands of bulky antennas — are placed in cities.

House Democratic leaders are set to roll out infrastructure legislation following the Martin Luther King Jr. Day recess. The legislation will likely feature provisions aimed at closing the digital divide, putting the issue of broadband internet access front and center ahead of the 2020 elections.

Sen John Kennedy (R-LA) is angling to hold more Federal Communications Commission hearings soon in his appropriations subcommittee overseeing the commission, still focused on how FCC Chairman Ajit Pai will structure a planned auction of 5G-friendly airwaves in the C-band. “Let me speak bluntly, we’re watching the FCC like a hawk,” said Sen Kennedy.
