FCC Proposes to Prohibit Import, Marketing of Covered Equipment

The Federal Communications Commission proposes to prohibit the continued importation and marketing of certain previously authorized equipment that has been determined to “pose an unacceptable risk to the national security of the United States or the security and safety of United States persons”. Such prohibitions would apply to the advertising, distribution, and sale of such equipment. In particular, we propose to apply such prohibitions to certain communications and video surveillance equipment listed in section 1709 of the Servicemember Quality of Life Improvement and National Defense Authorization Act for Fiscal Year 2025, added to the Covered List in December 2025. This would encompass all covered equipment produced by Anzu Robotics, LLC and its affiliates, subsidiaries, and other partners. These prohibitions would not apply to any importation or marketing for the purpose of use by the federal government, nor for the purpose of commercial testing and product development. Moreover, while importation and marketing would be prohibited, this prohibition would not affect continued use or operation of already-purchased covered equipment. We seek comment on these proposals and the relevant factors, including national security, economic, and supply chain considerations, that would justify prohibiting the continued importation and marketing of such previously authorized covered equipment.
