Preemption Of State AI Laws Is Not The Path Forward

The Trump Administration and the 119th Congress are pursuing AI legislation focused almost entirely on preempting any existing or future state AI laws, and these attempts have been staunchly opposed by a broad spectrum of technology, labor, and civil rights groups.

The administration and Congress continue to make state preemption a critical technology policy issue, with the administration making it a central part of its National Policy Framework for AI, the House Majority recently moving new child safety and privacy bills with state preemption, and reports that Rep. Olbernolte is preparing to release an AI bill that includes state preemption.
