For more than thirty years, the Federal Communications Commission’s authority to auction the nation’s airwaves proved to be an indispensable tool for harnessing the promise of new wireless technologies while also spurring economic growth, creating jobs, and strengthening our national security and international leadership. However, in light of the reality the agency has faced for almost a year, we are now compelled to ask what we can do with our current unassigned spectrum in order to keep innovation moving ahead in a global market for wireless that is not slowing down.

Here’s what to expect at the Federal Communications Commission's December open meeting.

• We’re going after junk fees that harm consumers and hamper competition.
• We’re cracking down on illegal robotexts.
• We’re making smartphones more accessible to consumers with hearing loss.
• We’re removing barriers to broadband deployment.
• We’re improving health care in rural communities.
• We’re protecting consumer data.
• We’re protecting local TV programming.
• We will also consider an item from our Enforcement Bureau.

Federal Communications Commission (FCC) Chairwoman Jessica Rosenworcel announced a proposal to eliminate video service junk fee billing practices by cable operators and direct broadcast satellite (DBS) service providers and study their impact on consumer choices. The proposal will be voted on during the December 13, 2023 Open Meeting. TV video service subscribers may terminate service for any number of reasons, including moving, financial hardship, or poor service.

Interested parties will likely use the change in Administrations as an opportunity to re-litigate settled disputes like the 5.9 GHz and 6 GHz rules, the L-band, and perhaps even the C-band.

On April 2, 2019, Reps Peter Welch (D-VT) and David Loebsack (D-IA) wrote to Federal Communications Commission Chairman Ajit Pai asking the FCC to take a more practical approach to implementing new performance testing mechanisms in connection with Connect America Fund (CAF) support. "We have heard..that the process of implementing network performance testing has grown complicated," they wrote, and that there were concerns, particularly among smaller CAF recipients, about the ability to implement such testing.
