Opponents of the T-Mobile-Sprint merger are piling on the deal in the hopes of convincing a judge the Justice Department’s settlement isn’t good enough. The DOJ’s agreement with the wireless companies has to receive final sign-off from Judge Timothy Kelly of the DC District Court, and critics want to make it a tough decision. Historically, the federal court review of a merger settlement has been an uneventful affair.

In a new filing, a group of seven economists and antitrust experts say a court should reject the Department of Justice’s proposed solution for the T-Mobile/Sprint transaction, calling it “doom[ed] ... to failure” and “a remedy that does not meet the standard of restoring the competition currently provided by Sprint.” For at least the next seven years, anyone buying service from Dish will just be getting rebranded T-Mobile service, and that’s not actual competition.

Attorney General Jim Hood (D-MS) reached an agreement with T-Mobile as an alternative to litigation against the phone company’s merger with Sprint. The following commitments were made:

Federal Communications Commission Chairman Ajit Pai announced that the items below are tentatively on the agenda for the October Open Commission Meeting scheduled for Friday, October 25, 2019.

Apparently, T-Mobile's bid to acquire Spring has received a third “yes” vote at the Federal Communications Commission.  All three Republicans on the five-member agency have voted for the deal, setting in motion procedures that would require agency action by Oct. 9, or Oct. 16 if an extension is requested by a commissioner. Neither agency Democrat has cast a vote, and both have called for delay.

House Science Committee Chairwoman Eddie Bernice Johnson (D-TX) wrote Federal Communications Commission Chairman Ajit Pai expressing concern about the potential interference of planned urban 5G networks with existing weather satellite sensors. The sensors, mounted aboard polar-orbiting satellites, are used to discern the presence and properties of water vapor in Earth’s atmosphere.

The Federal Communications Commission voted to seek comment on proposed application and bidding procedures for the auction of Priority Access Licenses (PALs) in the 3550-3650 MHz portion of the 3.5 GHz Band. The 3.5 GHz band holds the potential to be prime spectrum for 5G services, and the FCC is planning to auction PALs to increase innovation and investment in this band. Bidding in this auction, which is designated as Auction 105, is scheduled to commence on June 25, 2020.
