The House Communications Subcommittee held a long-delayed Federal Communications Commission oversight hearing July 25. Notably, FCC Chairman Ajit Pai stood by the FCC's decision to designate the Sinclair-Tribune deal for hearing. Full House Commerce Committee Ranking Member Frank Pallone (D-NJ) took the lead in pressing Chairman Pai on President Donald Trump's tweet criticizing the FCC for not approving the Sinclair-Tribune deal and his suggestion there was a need for a conservative voice like Sinclair's.

New York attorney general candidate Zephyr Teachout promised to “explore breaking up” Facebook and Google if she is elected, using state and federal antitrust laws. Standing in front of the Manhattan offices of the New York Daily News, Teachout said tech companies are to blame for dominating the online advertising market — drawing revenue from newspapers and publishers. Teachout’s remarks came a day after the Daily News in New York announced layoffs that reduced the size of its newsroom by half.

In the early evening of July 9th, President Donald Trump stood in the gold draped East Room of the White House with a small group of senior advisers to rehearse his announcement of Judge Brett Kavanaugh as his nominee for the Supreme Court. President Trump stepped on and off the podium, riffing with his aides.

The Office of Management and Budget announced Grant Schneider will be the second federal chief information security officer. As such, Schneider will lead cybersecurity strategy across the executive branch and chair the CISO Council. Schneider has been filling the CISO role in an acting capacity and is the National Security Council’s senior director for cybersecurity.

Congress is finally turning its attention to Silicon Valley, but to tackle these issues, congressfolk will first have to understand them. Which means it’s time to reboot the Office of Technology Assessment. The OTA was staffed with several hundred nonpartisan propellerheads who studied emerging science and tech. Every year they’d write numerous clear, detailed reports and they were on call to help any congressperson. It worked admirably. Its reports helped save money and lives. With a budget of only $20 million a year, the little agency had an outsize impact.

Judicial transparency group Fix the Court continues to try to get info on Brett Kavanaugh's time at the White House and working on the Starr Report. Kavanaugh, a judge on the U.S. Court of Appeals for the D.C. Circuit, was nominated this week to succeed Justice Anthony Kennedy on the Supreme Court. Kennedy is exiting at the end of July.

DC Circuit Court Judge Brett Kavanaugh’s appellate court decisions and public comments suggest that he will accelerate the trend toward a political system dominated by wealthy elites — often operating in the shadows, without any form of disclosure. At a March 2016 event at the American Enterprise Institute, Kavanaugh was asked point-blank if he believes that “money spent during campaigns does represent speech, and therefore deserves First Amendment protection.” His answer: “Absolutely.” In 2009, Kavanaugh authored an opinion in a case called EMILY’s List v.

The Cyber Diplomacy Act of 2018 (HR 3776) would codify the role and responsibilities of an existing office within the Department of State that works to advance US interests in cyberspace and coordinates US efforts to promote open, reliable, and secure communications technology. In addition, the act would require the US Government Accountability Office (GAO) to assess and report to the Congress on the extent to which international actors threaten the personal information of US citizens and the department’s efforts to protect such personal information.
